Location: Illinois Hi, so I have a bit of a complicated situation that I've been trying to figure out how to handle legally and quickly. I asked a police officer, secretary of state for the county, a random small claims attorney, and even my insurance lawyer and NOBODY could give me a solid answer!!! My grandma sold my van to her neighbors a while back without my knowledge or permission. We discussed selling it to them years ago but it fell through and I never fully agreed nor did they pay me anything for the van. The only thing they did pay me was about $195 to go toward buying a missing title and then the rest was so they could start driving the van before I agreed to anything because at the time my grandma needed rides. However, there was never a bill of sale, no other payments were made and I backed out of the process and 1-2 years later my grandma and I were even talking about selling it to a different person for parts but that also fell through because I told her I changed my mind. The title is and has always been in my name, there is no bill of sale, no written agreement let alone textual agreement. Now that's out of the way, here's my dilemma: I found out she sold it to them for $500 and they ended up paying to get it repaired and have been driving it. They keep getting pulled over in it and its coming back with a suspended flag- probably due to the registration not being renewed I'm guessing- so she's been bugging me about getting the title. I went to the DMV and the title will be mailed to my address. After that, I have to buy plates for it and get the registration renewed and I already confirmed with the DMV that is the only thing I'd need to do. Right now, the van is sitting on her neighbor's property by the side of the road. I'm trying to avoid confrontation with them and I just want to try taking it back by either molding the key on-site and then towing it, or showing up with the police to ask them for the key. Before you ask, no I haven't just asked them for the keys because I know they will not hand them over unless I either give them some amount of money (they said they wanted me to pay them for what they fixed) and with everything I have to pay for this van, I can't fork over anything to them right now. I was thinking about just asking my grandma for the key so I could give it a "test drive" because she did say they "wouldn't mind giving it back to me as long as I paid them the money they gave my grandma" so I could try to get around it that way and then after I'm in the van- well legally its mine so I wouldn't see why i would have to return it after that. Im really trying to avoid having to essentially admit to my grandma that I'm coming to take this van back. Ive been trying to figure out if I come to get the van from their property, can they stop me? They can't afford to take me to court and I know no attorney will take them. So, what would happen? Or since its legally in my name, if i bring the police to get the keys will they have to give them up? PLEASE HELP ME!! I have been without a vehicle for over a year now and my grandma has known how much of a setback and struggle this has been for me so I need to get this van back ASAP \[21st\], im not trying to wait.
