First time posting here, I've had my CDL for about five years but this is my first accident. I was issued the citation for an "Improper Turn." Company says they might help cover some lawyer fees, but that's about it. What happened was I missed my turn for my receiver, so I was looking for a place to turn around. I located a yard on the left side of the road with room in it for that. I swung right and slowed down in order to make the turn, but in the process of doing so, the guy behind me (also in a truck) decided that was the time to try to overtake me on the left. The road was a somewhat tight two way street with space on the right where trucks could pull over, so he was basically in oncoming traffic in order to do this. The front right of his truck impacted the front left of my truck, essentially destroying the axle and gearbox there and sending him onto the curb on the left hand side of the road. Police arrived shortly after and took both our sides of the story, and in the end issued me the citation for an improper turn. Their reasoning: The other guy stated that it appeared to him like I was pulling onto the shoulder on the right side to stop, and the police said to them it sounded like I was slowed down or even stopped far enough to the right side that that made sense to them. They also pointed out that because his truck impacted my truck, and not my trailer, that this also supports his side of the story, since it shows I was over far enough to have given him the room to have gotten up that far alongside me before impact. In my opinion this just shows how fast he was going to have been able to cross that distance in the time it took me to slow down and swing right before the left turn. After the collision, my turn signal was blinking right, despite the fact that I had turned it on left to show my intention to turn. This was also another unfortunate fact against me, and I believe this happened during the impact. It's the only assumption I can make being as I definitely didn't flip it to the right. In exchanging information with the other driver, it was discovered that his CDL was years expired. I know this doesn't affect the outcome of this specific case, but I feel like it's worth mentioning. Thoughts, opinions, advice? My company has told me I need to seek a lawyer and fight the ticket, but that they won't assist outside of possibly helping to recoup lawyer costs. I appreciate it, guys. EDIT: As for advice, I was specifically asking about what sort of lawyer I should be looking for. Figured I should clarify.
