Location: USMC military base In 2016, I was arrested while in the Marine Corps by base military police. I nearly have forgotten about this incident but it showed up on my FBI background/summary history check. Long story short, I blocked in someones car in his parking spot with my own car. That individual had a no contact order against my significant other and was at her work place. I called the police and after they arrived, I was eventually arrested for "unlawful detainment" I was taken for photos and fingerprints and released to my unit. This was the last I ever heard about this. My unit obviously thought it was nonsense and never pursued anything against me. I was never given a written counseling, NJP or court martial. The worse part of all this, it says "charge assault" for the arrest even though I was never charged. And I stayed in my vehicle until police arrived. So where the assault part comes, I can't say...my guess is that's the closest thing the UCMJ law matches for my suspected actions. Anyway, I never realized this would show up on the FBI background check. I'm trying to apply for a spousal visa in Spain and I'll have to give them this FBI sheet. Violent crimes can make the process more complicated, even though I never touched anyone or was ever charged with a crime to begin with. Things I'm considering are: * Removal of the arrest * Clarify the outcome/adjudication of the arrest * FOIA the case file (already requested) * See if I can get legal in the USMC or PMO to write a letter * Try myself to explain how dumb this is to Spainish immigration * Perhaps get a lawyer or some other subject matter expert to write a letter on the bureaucratic process of this to help explain it to the spanish immigration authorities I wouldn't even know where to get additional paperwork... PMO in the miliary has no ability to charge people, they can recommend but that is up to the commander of a unit/battalion. There is no court I can go to for this. There was never any charge that I point too and say "it's dismissed" or something like what would show up on the civilian side. It seems like the FBI database requires a crime to be inputed for an arrest which they then list as a "charge." I could understand "suspected of xxx". But factually, I was never charged. So I tell another country that the report is wrong, they naturally will take the FBI report at a higher value than my word. I'm in a bit of a time crunch and really need to get my visa application submitted within the next month or two at most. This doesn't really seem fair to me... but idk, I was hoping this subreddit can help provide some advice and clarity on steps or actions I can take.
