Location: Arizona, United States Mercedes dealership in Gilbert crashed my car while taking it to fill air in the tires. The driver side car bumper and side panel was smashed in and headlight was cracked. They accepted responsibility and said that they will get its repaired at an authorized dealer with original parts. We shared our concern that the value of the car will be impacted and want some remuneration or another similar vehicle. They said that the repairs will not be reported and that won’t impact the value of the car but did not guarantee that the damage will not be reported in the future or the car value will not be impacted. We did not push back initially but then sent them an email immediately after the incident to requesting a replacement vehicle (another 2024 GLB with the same amt of miles) or guarantee that the value won’t be diminished as our suggested paths forward. We were given a service vehicle while the vehicle was in repairs ( a little over a month) Once the repair was complete they said we need to return the service vehicle since our preferred options were not reasonable. We wrote them an email that the issue is not resolved but agreed to return the vehicle After returning the service vehicle the dealership emailed us saying the car was very dirty on return (we have had the car for over a month, have 2 young kids, and the seats of the vehicle were white leather). And need to charge us $300 for cleaning and said that they found a marker stain that is not coming out and it will cost $2000 for replacing the door panel. I know there were shoe stains on the back of seats (which came out) but dont remember seeing any marker stains. I feel like they are doing this in retaliation. Do I have any path forward. They hit my car, had it for over a month for repairs and instead of making up for the inconvenience they are trying to charge us $2000 for an inch light pink stain on the door. I was planning on filing a small claims case but wanted to get any advice before making the effort. Appreciate any replies. Clarification - we did not ask for a new replacement, we asked for a 2024 GLB with the same amount of miles (15k) on it.
