Location: NY I woke up Friday morning to an envelope stuck inside my mailbox with my name/address and "process server" written on it in my ex's horrible handwriting, so I know it was him who dropped it off. There was no certified mail label, no postage, no return address, or any indication of when it appeared at my home. Just there. I opened it to find disorganized papers telling me i had a virtual court date i must attend... in 4 days. Mind you I got this envelope on Friday, so the only day I could inquire about it is tomorrow, Monday. Court is 10am Tuesday. I messaged my ex asking what in the world he was doing and he claims he tried having me served 2 weeks ago, 5x in a week.. I guess I technically have no proof he didn't do that, but i'm 38 weeks pregnant and haven't left my house more than maybe once a day to grab food in weeks. It just didn't make logical sense. I don't see how I could have missed somebody 5 whole times over the span of a week, so I can only assume he's lying. Why would this alleged process server not leave notice that he was trying to find me? My question is, since the court was unhelpful when I called Friday, is throwing an envelope into my mailbox FOUR days before a court date legal service in any way? I've had to serve papers to him before and I don't recall having any options besides certified mail if hand off service couldn't be completed. There was also a set deadline that I had to serve him by and it absolutely was not 4 days before court. I never got anything in the mail, on my door, or a single message from him about any of it. I plan on just joining the virtual court Tuesday and asking for the case to be dismissed because I wasn't served properly and therefor didn't have any time to get my case together. He's been out of my son's life 100% for the past 10 years, and is now asking to reduce his child support to punish my son for recently going through with changing his last name. He literally filed 3 days after my son's name was changed. Because of this, I feel he purposely is attempting to get me to no show so he gets default judgement, as he absolutely has no chance in court. I don't even know what to do with any papers I need to submit. I was given an income / expenses paper that states on it that I must bring it with me to court.. but it's virtual so i don't understand how that's going to work if it wasn't prior submitted to the court. I literally had no time to submit anything and am now scrambling to get other papers together like w2's, tax records, proof of his abandonment, ect. Does anybody have any advice on how I could remedy this? Also just for clarity I live in a single family home. There's no way he could have screwed up my address and had the server going to the wrong place unless he gave them the wrong address. I also have a ring door bell that I thought I could go through to see if anybody came that week but unfortunately I realized the record option was off :( Being heavily pregnant I've been waking up later (like 11a-12p) since I can never sleep through the night, so if service was ever attempted before like 1pm i was 100% home. I have two incredibly annoying chihuahuas that bark at everything so you bet I would have woken up if someone knocked on my door.
