Location: Utah I really need some assistance. This entire experience has been so stressful. It’s a bit of a mouthful please hang in there with me. I Live in Utah. I moved out of my apartment after giving 3 months notice and my lease ending at the end of August. It has been a fight just getting the apartment complex to do literally anything. I knew their office hours from living there but also knew they rarely were in office or answered the phone. I kept to myself while living there over the last 2 1/2 years. But I’ve had issues with the management before including getting random charges with no explanation and when I asked them about it they would just say “sorry” and refund me the extra money. Sketchy. I also never received an amenities key. I set up a time during their business hours to turn in my keys. I get there and the office is closed. There were people waiting out front trying to get in because their rent wasn’t posted to the app and they didn’t want to get charged fees. I asked a maintenance worker for assistance and they unlocked the office where the entire management team was hiding from the tenants. I turned in my keys and signed the paperwork as well as gave them my forwarding address. They said they were going to charge me for the amenities key. I told them I never got one and that I called 5 times about it and sent emails asking for one. They said “oh sorry”. I finished and left. I also gave them a copy of a receipt for a professional cleaning of the whole apartment and carpets to make sure I get my deposit back. I know Utah law says they have to give the deposit back along with a list of any deductions within 30 days. Well 38 days later they finally called me back about the deposit and said it was ready. They said they closed at 6:00pm on that day (10/8) and were only open 10:00am-12:00pm the next day. I went both after work at 5:30pm that day and at 10:30am the next day. No one was there. I also called 8 times within their “open hours” both days. No response. I sent an email. No answer until 10/13. They basically just said well these are our hours (the same hours I’ve been calling and come to get the check at). I asked they mail the check since no one is ever at the office and it’s already past the legally required 30 days. They asked if my address (which I had already left them when I moved out). I gave it to them on 10/14. No response. 10/20 a week later no check. I call 2 times no answer. I email no answer. The next day I’m about to make the 45 minute drive there again bit call first. For the first time in over a month they answer my call. They very rudely tell me they say my email and the check was send on 10/14. 10/25 I get the check with an almost $1000 in deduction and no list or reason for them. So here’s my question From my understanding they can’t take deductions after if they don’t give a list of the deductions before the 30 days? They didn’t answer about the deposit until 8 days after the check and the list of potential deductions where due but did not have their office open during their schedule hours or answer the phone for weeks after that. The postage date says they didn’t send even send the check until 10/21 not when I asked for it to be mailed on 10/13. I was willing to let go the lateness of the deposit even though I think I’m within my rights to take action at that point but now they are also making up deductions with no explanation past the time they can’t take even legal take any of the money. I send them an email with the full timeline saying I am demanding my full deposit back or I will be taking them to small claims court. I also sent them copies of all the calls and emailed I had sent unanswered. They put hidden in the lease that “if we fail to give an itemized list of the deductions I can not sue for damages”. Which the law says I can. Weird that they are already planning to fail to give the legally required reason for damages. Does the lease really take away my ability to seek damages now that they have failed to return the deposit until much past the legal date and after this whole ordeal to simply get them to do their job, answer the phone and be available during business hours? Plus their shady history of charging mysteries fees that when questioned about they just drop? I just feel like they have been and are taking advantage of me at every turn.
