So I worked under Local 675 for a drywall company from june 2024 to may 2025. My official classification was 3rd-term apprentice at $36.97/hour, which matches the 2025 collective agreement rate. Basically i was still an apprentice I started doing drywall work but after 3 days in I pointed out a safety violation, then my boss told me don't talk to him about that bs just work. So whatever, Next flipping day he puts me on labor duty, which is allowed sorta cause im an apprentice so theres a loophole that u can get apprentices to do "housekeeping duties" . But the problem is it wasn't just labor work : After my first week, I was put in charge of things well above my classification supervising multiple workers (usually 2-4 laborers and always 2 first term drywallers), managing drywall and metal deliveries (i have receipts of billings as well from the delivery guy, deliveries were a daily occurrence i had to decide where to put the material and keep a personal inventory at all times.), tracking crew hours (he would text me how many hours did everyone work?), organizing jobsite materials, and coordinating with site supers from other trades. I have at least a hundred calls in my daily logs, and daily texts from everyone from electricians to building superintendents. even my foreman texting me directly to discipline those under me and telling me when and where to send "my" laborers. Basically, I was functioning as a foreman or lead hand but was still getting apprentice pay. From what I understand, the Local 675 CBA requires that anyone performing foreman duties be paid at the foreman rate ($60.73/hour). That’s a $23.76/hr difference from what I was paid. Over roughly 1,400 hours of work, that’s about $33,264 in unpaid wage difference (I used ChatGPT for the math). Would this kind of pay misclassification be a CBA violation, or can I claim it directly through the Ontario Labour Relations Board or Ministry of Labour if the union doesn’t act? Im just looking for anyone who’s seen these types of cases before, and can an apprentice get back pay for doing foreman level work? || || |||
